Terms & Conditions for all services offered by Lex Designs. Please read before purchasing anything from us.
Website Maintenance
- Scope of Services:
Our website Maintenance plan includes a comprehensive range of services tailored to meet your website’s needs. Depending on the plan chosen, these services may include:- Hosting and domain name management
- Daily website backups
- Anti-virus protection
- Regular software and plugin updates
- Business email setup and management
- Email support for any queries or technical issues
- Performance optimisation to ensure your website runs smoothly
- Monthly website reports to track performance and identify areas for improvement
- Monthly SEO audit to assess and enhance your website’s search engine visibility
- Client-requested updates to make changes and improvements to your website as needed
- Payment and Subscription:
Our Monthly Maintenance Plan operates on a subscription basis, with payments processed monthly via direct debit. By default, subscriptions are set to auto-renew annually unless the customer contacts us to change it. - Missed/Late Payments:
- If payment has not been made after 14 days a £25 late fee will be applied to the account and the website will be suspended until full payment is received.
- If the outstanding balance remains unpaid one month after the missed payment date, services will be terminated, including the website and associated email services. A £50 reactivation fee will apply if the website is terminated.
- Payment deadlines may be adjusted due to mitigating circumstances, provided clients communicate these circumstances to us in advance.
- Service Level Agreement:
We aim to provide prompt and efficient service to our clients. Support requests will be acknowledged within 12 hours, and client-requested updates will be handled as soon as possible. Please note that complex requests may incur additional costs. The timeline for completing updates depends on the scope of changes required. - Cancellation and Termination:
No cancellation is permitted within the first year of the contract, unless client pays a cancellation fee. The cancellation fee is the remainder of the contract. After the first year, clients may cancel their subscription at any time. Cancellation or termination of services includes the associated email services. Websites that have been terminated will incur a £50 reactivation fee. - Warranties and Liability:
While we warrant that all services provided will be of professional quality, we cannot be held liable for any consequential damages. - Changes to Terms:
We reserve the right to modify these terms and conditions at any time, and clients will be notified via email of any changes. - Governing Law and Dispute Resolution:
Any disputes arising from this agreement shall be governed by the laws of the UK. The parties agree to attempt to resolve any disputes through mediation before pursuing legal action.
Website Design
- Scope of Work:
The specific terms and conditions for the project will be outlined in a separate document to be signed by both parties. - Client Responsibilities:
The client is responsible for providing all necessary materials, such as logos, images, and content, as well as timely feedback throughout the design process. - Payment Terms:
- A 50% non-refundable deposit is required before any work commences, with the final payment due upon completion of the project unless otherwise agreed upon.
- Payments are accepted in GBP through Stripe invoice, PayPal, or Bitcoin to the desired Bitcoin wallet.
- Payments must be made promptly to avoid the risk of forfeiting the deposit.
- Intellectual Property:
Ownership of all website elements, including design, content, and code, will be transferred to the client upon receipt of full payment. - Timeline and Deliverables:
- The project timeline will include milestones and deadlines for revisions and final delivery.
- The client will receive up to five rounds of revisions and access to the website’s backend for content management.
- Warranties and Liability:
The design agency warrants that all services provided will be of professional quality. However, the agency shall not be liable for any consequential damages. - Termination and Refunds:
- The 50% deposit is non-refundable.
- In the event of project termination, any expenses incurred by the design agency must be reimbursed by the client.
- Governing Law and Dispute Resolution:
Any disputes arising from this agreement shall be governed by the laws of UK. The parties agree to first attempt to resolve any disputes through mediation.
Graphic Design
- Scope of Services:
The specific terms and conditions for the project will be outlined in a separate document, provided with the proposal for your review and acceptance. - Client Requirements:
By engaging our services, the client agrees to provide timely feedback, necessary materials, and access to relevant systems to facilitate the project’s progress. The client also agrees to adhere to the agreed-upon payment schedule and make all payments promptly and on time as outlined in the contract. - Payment and Pricing:
- A 50% non-refundable deposit is required before any work commences, with the final payment due upon completion of the project unless otherwise agreed upon.
- Payments are accepted in GBP through Stripe invoice, PayPal, or Bitcoin to the desired Bitcoin wallet.
- Payments must be made promptly to avoid the risk of forfeiting the deposit.
- Copyright:
Upon full payment, the client is granted full ownership and unrestricted usage rights to all copy and content created. This includes, but is not limited to, slogans, taglines, website copy, and marketing materials. However, the designer retains the right to showcase and feature the work, including excerpts of the copy, on the designer’s professional portfolio and social media channels, specifically Instagram, for promotional purposes. - Delivery and Revisions:
- The project timeline varies depending on the scope of the project, as discussed during initial consultations.
- The client will receive up to five rounds of revisions, with all files delivered via email after final payment has been made.
- No documents will be sent until final payments have been received.
- Warranties and Liability:
The design agency warrants that all services provided will be of professional quality. However, the agency shall not be liable for any consequential damages. - Termination and Refunds:
- The 50% deposit is non-refundable.

templates & Downloads
- Usage Rights:
Customers are granted non-exclusive, non-transferable rights to use templates and downloadable materials for personal or business purposes only. Redistribution, resale, or modification of the materials is strictly prohibited without prior written consent. - Intellectual Property:
All templates and downloadable content remain the intellectual property of Lex Designs unless otherwise stated. Customers are granted a limited license to use the materials in accordance with these terms and conditions. - Payment and Pricing:
Pricing for templates and downloadable materials is clearly displayed on our website and may vary depending on the type of product or license. Payments can be made securely through our online payment gateway using various accepted methods, including credit/debit cards and PayPal. - Delivery and Access:
Upon successful payment, customers will receive instant access to the downloadable materials through a secure download link provided on our website. Delivery methods may vary depending on the nature of the product, with digital downloads being the primary mode of delivery. - Refunds and Returns:
Due to the nature of digital downloads, refunds are generally not offered unless the product is found to be faulty or not as described. Customers are encouraged to review product descriptions and previews before making a purchase. - Warranties and Liability:
While every effort is made to ensure the accuracy and quality of our templates and downloadable materials, Lex Designs cannot guarantee their suitability for specific purposes. Customers are responsible for verifying compatibility and suitability before using the materials. In no event shall Lex Designs be liable for any direct, indirect, incidental, special, or consequential damages arising out of the use or inability to use the downloaded materials. - Governing Law and Jurisdiction:
These terms and conditions shall be governed by and construed in accordance with the laws of UK. Any disputes arising from the use of our templates and downloadable materials shall be subject to the exclusive jurisdiction of the courts in UK.
